New Homestead Filing Requirements

The recent session of the Texas Legislature passed House Bill 252 effective September 1, 2011 has new  requirements for The Residential Homestead Exemption, Over 65 Exemption, Disabled Person’s Exemption and the 100% Disabled Veterans Exemption that must provide proof the home they live in is their principal residence.

Listed below are the exemptions affected by House Bill 252 and the required documents needed for each exemption. 

·         THE GENERAL RESIDENCE HOMESTEAD EXEMPTION– a copy of the completed exemption application form 50-114, a copy of your current drivers license or Texas I.D. card (the address must match that of your principal residence) and a copy of your current vehicle registration.  If you do not own a vehicle fill out the affidavit form attached with the exemption application, have it notarized and then attach a copy of a current light bill showing the service address and your name. 

·         OVER 65 EXEMPTION – a copy of a completed application form 50-114, a copy of your current drivers license or Texas I.D. card (address must match that of your principal residence) and a copy of your current vehicle registration.  If you do not own a vehicle fill out the affidavit form attached with the exemption application have it notarized and then attach a copy of a current light bill showing the service address and your name. 

·         DISABLED PERSON’S EXEMPTION – a copy of the completed application form 50-114, a copy of your current drivers license or Texas I.D. card (address must match that of your principal residence) and a copy of your current vehicle registration.  If you do not own a vehicle fill out the affidavit form attached with the exemption application have it notarized and then attach a copy of a current light bill showing the service address and your name.

Also attach a copy of a current dated letter from the Social Security Administrations office that clearly states the date you became disabled. 

·         100% DISABLED VETERANS EXEMPTION- a copy of the completed application form 50-114, a copy of your current drivers license or Texas I.D. card (address must match that of your principal residence) and a copy of your current vehicle registration.  If you do not own a vehicle fill out the affidavit form attached with the exemption application have it notarized and then attach a copy of a current light bill showing the service address and your name.

Also attach a copy of a current dated letter from the Veterans Administrations office clearly stating you are 100% service connected disabled –or paid at the 100% service connected unemployability.  

NOTE:

MOBILE HOME OWNER’S ONLY- Attach a copy of the mobile title issued by the Texas Department of Housing and Community Affairs, or a notarized copy of the bill of sale.  If you do not have either one you may fill out the attached manufactured home affidavit in its place and have it notarized. 

MARRIED COUPLES WITH DIFFERENT LAST NAMES- Attach a copy of your marriage license. 

MULTIPLE OWNER’S WHO ARE NOT MARRIED- Go to our website and download the form “Request for Separate Taxation of Undivided Interest” all owner’s  must fill it out, sign and attach copies of their current driver’s licenses.
